Posted December 12, 2025The foregoing ordinance was introduced at a meeting of the Governing Body of the Borough of East Newark held on November 12, 2025 and was read for the first time. This ordinance will be further considered for final passage by said Mayor and Council of the Borough of East Newark at the East Newark Borough Hall at 34 Sherman Avenue, East Newark, NJ 07029 at a meeting beginning at 6:30 p.m., on December 29, 2025 or at any time and place to which such meeting may be adjourned. All persons interested will be given the opportunity to be heard concerning such ordinance. Copy of this ordinance is posted on the bulletin board in the Municipal Building and a copy is available up to and including the time of said meeting to the members of the general public, free of charge.

Ordinance of the Borough of East Newark, County of Hudson, State of New Jersey to Address the
Borough’s Compliance with its Affordable Housing Obligations
Summary of Ordinance
The purpose of this ordinance is to establish a mandatory 20% affordable housing set-aside for all multi-family developments of five or more units, consistent with the Borough’s Housing Element and Fair Share Plan and state affordable housing laws and require compliance with UHAC standards, long-term affordability controls, proper unit distribution, and integration of affordable units with market-rate units.

Ordinance of the Borough of East Newark, County of Hudson, State of New Jersey, Amending Chapter 32 to Create a New Section Entitled “Affordable Housing Development Fees”
Summary of Ordinance
The purpose of this ordinance is to create a new chapter establishing Affordable Housing Development Fees in the Borough of East Newark. It authorizes the collection of development fees from residential and non-residential projects, sets the applicable fee percentages, identifies exemptions, and outlines the procedures for collecting and administering these fees. All collected funds will be deposited into the Borough’s Affordable Housing Trust Fund and used exclusively to support affordable housing programs in accordance with a Court-approved Spending Plan.

Ordinance Adopting the Silvi Concrete Plant Redevelopment
Plan Summary of Ordinance
The purpose of this ordinance is to adopt the Silvi Concrete Plant Redevelopment Plan for properties located at 800 Passaic Avenue (Block 18, Lots 1–6) and 246 Passaic Avenue (Block 16, Lot 17). The plan establishes new zoning and development standards for the site to guide its redevelopment in accordance with the Borough’s Master Plan and the Local Redevelopment and Housing Law.
This ordinance shall take effect immediately upon final adoption and publication according to law.
